With tech layoffs highlighting the drawbacks of the H-1B visa, more and more Indians are exploring the\u00a0EB-5 visa<\/a>\u00a0route to settle in the US.<\/p>\n

Investing $1.05 million, or $800,000 in case of a Targeted Employment Area, in a new commercial enterprise and creating at least 10 jobs in the US will help the investor qualify for the EB-5 visa.<\/p>\n

The investor and eligible dependent family members are issued conditional permanent residence for a period of two years upon approval of the I-526 petition.<\/p>\n

If the investment and job-creation conditions are fulfilled, then the applicant can apply for removal of conditions and become a permanent resident.<\/p>\n

EB-5 Advantage for Indians Working in the US<\/h3>\n

The biggest advantage that the EB-5 visa offers to somebody already living and working in the US is that permanent residence, for all practical purposes, begins from the approval of the I-526 petition.<\/p>\n

From having just 60 days to find a new job on a H-1B visa, somebody living in the US can compare options to find the best job possible or even begin his or her own venture in the US without any visa restrictions by qualifying for the EB-5 visa.<\/p>\n

Surge in Applications Since 2016<\/h3>\n

Unsurprisingly, there has been a massive increase in the number of Indians opting for the EB-5 visa. Applications by Indians rose from 756 in 2019 to a record 1,381 in 2022. And this jump came after applications surged by 400 percent between 2016 and 2019.<\/p>\n

Indians were second in the list of countries that received the highest number of EB-5 visas out of the 10,885 visas issued in 2022. In 2023, the US is expected to issue around 14,200 visas.<\/p>\n

The Reservation Advantage<\/h3>\n

The EB-5 Reform and Integrity Act of 2021 has made the EB-5 route even more popular among Indians. This Act reserves 20 percent visas for rural TEA projects, 10 percent in high-unemployment TEA projects, and additional two percent to infrastructure projects.<\/p>\n

Unused reserved visas will be carried forward, which means this is a useful option for applicants from India and China facing a backlog in the general EB-5 pool.<\/p>\n

Regional Centers for Hassle-Free Investments<\/h3>\n

The direct EB-5 route is an option but most EB-5 applicants, including Indians prefer the Regional Center route. This option gives applicants the advantage of pooling funds into a big-ticket project, active management through oversight of a professional team of managers, and inclusion of indirectly-created jobs when fulfilling the job-creation requirement.<\/p>\n

Finally, the EB-5 route has become popular even among those not facing the risk of layoffs because of significantly-lower processing times for this visa. Unlike the EB-1 and EB-2 route, an EB-5 investor can look to becoming an unconditional permanent resident within five years of filing the I-526 petition.<\/p>\n

The Reform and Integrity Act permits concurrent filing, which means the applicant file for removal of conditions concurrently with the I-526 petition.
